These Terms of Use (the “Terms”) govern your access to and use of the Constructico website, the Constructico recruitment platform, and any related services (together, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and “you” refers to that company.
1. The Service
Constructico is a recruitment platform built for the construction industry. It lets employers and recruiters create and distribute job posts, search for and communicate with candidates, screen applicants, schedule interviews, and manage their hiring pipeline. Parts of the Service use automated and AI-assisted processing, which is described in the Platform Privacy Policy.
2. Accounts
You need an account to use the platform. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly if you believe your account has been compromised.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or in violation of employment, anti-discrimination, or telemarketing laws that apply to you;
- post job listings that are misleading, discriminatory, or not genuine open positions;
- send messages through the Service to people who have opted out of hearing from you;
- scrape, harvest, or bulk-export data from the Service outside the features we provide;
- reverse engineer, resell, or sublicense the Service without our written agreement;
- upload malicious code or attempt to disrupt or gain unauthorized access to the Service.
4. Your content and your responsibilities
You retain ownership of the content you submit, including job posts, candidate notes, and message templates. You grant Constructico a license to host, process, and display that content as needed to operate the Service. You are responsible for the hiring decisions you make and for your compliance with the laws that govern your recruiting activity, including equal-opportunity rules, consent requirements for calls and text messages, and any obligations that apply to automated hiring tools in your jurisdiction. The Service provides decision support; it does not make hiring decisions for you.
5. Communications sent through the platform
The platform can send email and text messages and place calls on your behalf. You must have a lawful basis to contact each recipient, honor opt-outs, and follow the rules that apply to recorded calls in the relevant states. Constructico enforces opt-outs on the platform level and may suspend messaging that generates complaints, bounces, or carrier violations.
6. Fees
Paid features are billed according to the plan you select. Fees are non-refundable except where required by law or stated otherwise in your order. We may change pricing with notice effective from your next billing period.
7. Intellectual property
The Service, including its software, design, and branding, is owned by Constructico and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the right to use it as intended.
8. Third-party services
The Service integrates with third-party job boards, calendar tools, and communication providers. Their services are governed by their own terms, and Constructico is not responsible for third-party services.
9. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee that any role will be filled, that any candidate is suitable or available, or that the information in candidate profiles, market reports, or AI-generated summaries is complete or error-free. Verify important information before acting on it.
10. Limitation of liability
To the fullest extent permitted by law, Constructico will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to the Service. Our total liability for any claim will not exceed the amounts you paid to Constructico for the Service in the twelve months before the claim arose.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access that violates these Terms or creates risk for the Service, other customers, or candidates. On termination, sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) survive.
12. Changes
We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, for significant changes, notify account holders. Continued use of the Service after changes take effect constitutes acceptance.
